GENERAL CONDITIONS OF SA LES ARDENTES

ARTICLE 1 – PURPOSE – SCOPE OF APPLICATION

These general conditions (hereinafter “the Conditions”) contain the conditions of use of the website www.lesardentes.be (hereinafter “the Site”) as well as the general conditions of sale of the services sold by SA Les Ardentes (hereinafter the “Services”) to the Customer via the Site or through official partners linked to the “les Ardentes” festival (hereinafter the “Festival”).

The Conditions apply to any contract concluded between SA Les Ardentes and its customers (hereinafter “the Customers” or the “Customer”), whether directly via the Site, or through one of its official partners (hereinafter “Contract”) and form an integral part of the Contract.

Prior to using the Site, the Customer is required to carefully read these Conditions. By using the Site or placing an order on it, the Customer accepts, unless he establishes proof to the contrary, to be bound by these Conditions.

The Customer's attention is expressly drawn to the fact that in the event of purchasing Services on behalf of third parties for whom he is presumed to be an agent, it is his responsibility to communicate to these third parties these Conditions as well as any other conditions which would apply to this Contract and to obtain their adhesion to them at the latest at the time of the conclusion of the Contract. The tickets sold by SA Les Ardentes and relating to the Services purchased by the Customer are nominative. Therefore, either the Customer will enter himself, when placing the order, the data necessary for the personalization of tickets acquired on behalf of third parties, or he will communicate the necessary information so that the useful instructions can be directly sent to these third parties so that they can personalize their ticket(s) themselves.

The Customer's attention is also expressly drawn to the fact that when a Contract relating to Services offered by SA Les Ardentes is concluded through one of its official partners, it may result that the own general conditions of this official partner are applicable, in addition to these Conditions, the latter must, in any case, in this case, prevail.

The official partners of SA Les Ardentes are obliged to provide the Client with these Conditions at the latest when placing the order for Services.

Only tickets sold by SA Les Ardentes and its official partners will be considered valid. SA Les Ardentes reserves the right to refuse access to the Festival, the campsite and the car parks to any person who is not in possession of a valid access permit.

 


ARTICLE 2 – COMMERCIAL NAME – CONTACT DETAILS

The sale of the Services is carried out under the commercial name “Les Ardentes” by SA Les Ardentes, whose head office is located at 4000 Liège (Belgium), Boulevard de la Sauvenière 118, registered with the Carrefour Bank for Companies under number 0806.356.347.

The Customer can contact SA Les Ardentes, either at the above-mentioned address or at the following email address: helpdesk@lesardentes.be 


 

ARTICLE 3 – ACCESS TO THE SITE – REGISTRATION

Access to the home page of the Site as well as its content is free without the prior creation of an account being required. Placing an order for Services on the Site can be done either by prior creation of an account on the Site, or as a guest, without the creation of an account being necessary.

Creating an account on the Site as a Customer implies having previously read and accepted these Conditions without reservation.

The Conditions contain the conditions of use of the Site and the sale of the Services by SA Les Ardentes. Before validating the creation of his account, the Customer will be asked to confirm that he has actually read them and that he accepts them, unless he establishes proof to the contrary. Once the creation of his account on the Site is complete, the Customer will receive a copy of these Conditions by email in PDF format.

SA Les Ardentes may, at any time, modify and adapt these Conditions in order to:

a) to bring them into compliance with the legislative or regulatory provisions in force or in the process of being adopted to which it is subject;

b) to make them conform to any decision rendered by a judicial or arbitral jurisdiction, or issued by any other competent authority whose decisions are binding on it;

c) to correct any material error.

The applicable Conditions will be those in force at the time of use of the Site or conclusion of the Contract.

Without prejudice to the applicable legislative and regulatory rules, SA Les Ardentes will notify any modification and/or adaptation of the Conditions, or any other rule relating to the use of the Site by means of a message sent to Customers via the Site, at the latest fifteen days before the entry into force of the modification or adaptation in question.

This notification will be duplicated, in the event that the adaptation or modification that SA Les Ardentes intends to make would result in a substantial modification of the Customers' obligations or having a significant impact on the operating methods of the Site, an email addressed to the Customers on the email address provided during registration.

The Customer who does not wish to agree to the modifications made remains free to request the deletion of his account on the Site by sending, for this purpose, a request to the address helpdesk@lesardentes.be

 


 

ARTICLE 4 – PLACING THE ORDER ON THE SITE

To place an order for the Services sold by SA Les Ardentes on the Site, the Customer must connect to the Site, select the Services they wish to purchase and place them in their shopping cart.

The Customer can then either log in to their account or log in as a guest to place the order.

The total amount of the order, all taxes included, is included in a summary of the order and the Customer is then invited to confirm his willingness to pay for the order in accordance with the means put in place for this purpose and referred to in article 5. He must also accept the Conditions.

The provision of tickets is subject to the condition of prior payment of the order.

Once payment has been made, the Customer receives confirmation of his order, as well as tickets relating to the services purchased by email with a copy of these Conditions. In the event that the Customer acquires tickets for other people, it will be his responsibility either to complete the data necessary for the personalization of these tickets, or to communicate when placing the order the email address of these people in order to that they can receive an email informing them of these Conditions and useful information allowing them to personalize their ticket(s) themselves.

 


ARTICLE 5 – PRICE – PAYMENT

Prices are stated in euros, VAT included.

If SA Les Ardentes detects an error in the price of the Service(s) ordered, it will inform the Customer as soon as possible and will offer to either confirm their order at the correct price or cancel it. . If SA Les Ardentes is unable to obtain a response from the Customer on the alternative offered to it within eight calendar days, it will cancel the order and reimburse the amount paid.

The payment methods offered on the Site are, in particular, the following: Visa, MasterCard, Maestro, American Express, Bancontact.


ARTICLE 6 – PLACING THE ORDER THROUGH AN OFFICIAL PARTNER OF SA LES ARDENTES

The Customer can also obtain tickets for the Festival, as well as, where applicable, tickets for parking spaces and camping pitches through an official partner of SA Les Ardentes.

In this case, the Customer will be subject to the ordering, payment and ticket sending process set up by this official partner.


ARTICLE 7 – ABSENCE OF RIGHT OF WITHDRAWAL

Under article VI.53, 12°, Code of Economic Law, the Customer does not have a right of withdrawal of 14 days starting from the date of conclusion of the Contract. The Contract concluded is therefore definitive subject to the possibilities of exchange and resale provided for in these Conditions.


ARTICLE 8 - LIABILITY

Management and use of the Site

SA Les Ardentes will ensure that its Site is accessible to Customers and, more generally, to Internet users, in a continuous and uninterrupted manner. However, SA Les Ardentes reserves the right, at any time and without notice, to interrupt access to the Site, in particular for technical or security reasons and to therefore suspend its services.

Except in the event of fraud or gross negligence on its part (including that of its employees or agents), or, apart from the case of force majeure, non-performance of an obligation consisting of one of the main services of the Contract, the SA Les Ardentes cannot be held responsible for any possible harmful consequences whatever they may be (for example, loss of opportunity, loss of time, loss of earnings, etc.) which could result from these interruptions.

Except in cases of fraud, gross negligence (including that of its employees or agents) or, apart from the case of force majeure, non-performance of an obligation consisting of one of the main services of the Contract, SA Les Ardentes declines any liability in the event of error, omission or inaccuracy of the information provided on the Site. Furthermore, in the event that the Site contains hypertext links to content from third parties, SA Les Ardentes cannot guarantee the quality or accuracy of this content and cannot be considered as approving this content.

SA Les Ardentes is not responsible for the management by Customers of their username and password, nor for the management of their account.

SA Les Ardentes is also not responsible for the content of the website of its official partners.

Limitation of liability

The liability of SA Les Ardentes cannot, except in cases of fraud, gross negligence (including that of its employees or agents) or, except in the case of force majeure, non-performance of an obligation consisting of one of the main services of the contract, be committed.

In the event that the liability of SA Les Ardentes is incurred notwithstanding the hypotheses of limitation and exemption from liability provided for in these Conditions, it will then be limited to direct damage (excluding indirect damage), and in all state of affairs, to the amount of the price of the Service(s) sold.

By way of derogation from the above, the liability of SA Les Ardentes will not be subject to any exclusion or limitation in the following cases: (i) death or bodily injury caused by an act or omission of SA Les Ardentes; (ii) fraud; or (iii) in any case where a limitation of its liability would be illegal or abusive.

The Client's attention is drawn to the fact that SA Les Ardentes cannot incur any liability for any damage, theft, damage and accidents occurring in the car parks and campsites made available to Clients around the Festival. The Customer therefore accepts that the use of these car parks and campsites is carried out under his own responsibility and at his own risk.


ARTICLE 9 - FORCE MAJEURE

SA Les Ardentes will not be liable for the non-performance or delay in performance of any of its obligations when this non-performance is due to a case of force majeure in the sense that this concept is covered by article 5.226 of the Civil Code.

For the application of this article, the following circumstances are considered in particular as cases of force majeure and constitute causes for suspension or extinction of the obligations of SA Les Ardentes (without this enumeration being exhaustive) which render execution of these obligations (with the exception of payment obligations) impossible, dangerous, impracticable or unreasonable: fire, natural disaster, exceptional climatic and/or weather events, unfavorable weather conditions (or risk of occurrence of weather conditions) considered by the authorities competent as constituting a threat to the security of persons and/or property, national or international emergency, strike, act of hostility towards the State, act of terrorism or threat of terrorism, riot or popular movement, accident, interruption or delay significant or failure of technical installations, failure or significant delay of necessary transport services, exceptional difficulties and impossibilities of using the means and channels of transport, order or command of Belgian, European or foreign public authorities, changes in Belgian, European or foreign, epidemic, pandemic, machine breakdown, (threat of) war, act of third parties or any external event likely to delay or prevent the execution of the obligations concerned…

In accordance with what is provided for in article 11 of these Conditions, it is expressly specified that the change in the Festival's programming, independent of the will of SA Les Ardentes, does not constitute a case of force majeure within the meaning of this provision and therefore does not give rise to any right to any reimbursement on the part of the Customer.

In the event of force majeure, the obligations of SA Les Ardentes will be suspended for the entire duration of the force majeure and its execution deadlines will, where applicable, be extended by a period equivalent to that of the duration of the force majeure. major, if such an extension is materially possible.

If the case of force majeure results in a definitive impossibility of performance of the obligations of SA Les Ardentes, SA Les Ardentes will be released from them. SA Les Ardentes will notify the Client by any means it deems useful (notice on the Festival website, email, notice on the website, notice in the press, on social networks, etc.).

Where applicable, the Customer will be entitled, according to the applicable legal provisions, to a refund of all or part of the ticket purchased, depending on whether force majeure results in the cancellation of all or part of the Festival. Only tickets for the Festival sensu stricto will, in this case, give rise to a total or partial refund, excluding parking tickets and camping tickets.

 


ARTICLE 10 – CASHLESS PAYMENTS DURING THE FESTIVAL

A cashless payment system is set up within the Festival grounds and constitutes the only means of payment accepted within this venue.

This cashless payment system is used by means of a personal electronic bracelet made available to the Client in exchange for the entry ticket on which money is loaded either online via the Client's banking application or directly at the recharging points (in cash or by bank card). The bracelet can be loaded even before the start of the Festival, via the link available for this purpose on the Site.

Where applicable, SA Les Ardentes may accept payment methods other than cashless payment.

For the organization and implementation of this cashless payment system, SA Les Ardentes uses a payment service provider: Weezevent, which assumes full responsibility, vis-à-vis Customers, for the proper functioning of said system.

Therefore, in the event that a problem is encountered in the operation of this cashless payment system, SA Les Ardentes cannot be held responsible. It may, if necessary, put in place alternative means of payment to compensate for possible malfunctions.

Customers acknowledge and accept that they bear the risks of loss and theft of their electronic bracelet. It is the responsibility of Customers to immediately report the loss or theft in question and to have their electronic bracelet deactivated via the (re)charging point located inside the Festival site or at the accreditation point located at the exterior of it.

Claims

Customers are required to report any dispute relating to a transaction linked to the cashless payment system via the Site and/or to the address helpdesk@lesardentes.be by attaching any supporting documents necessary for the processing of the request.

Dedicated contact points are also present on the Festival site and made available to Customers throughout the duration of the Festival.

Refunds

Reimbursement of the money loaded on the electronic bracelet can be requested within 15 days at the latest from the end of the Festival and only for amounts greater than or equal to €5.


 

ARTICLE 11 – INTERNAL RULES

Access and programming

The Festival runs from July 11, 2024 to July 14, 2024.

The opening hours of the Festival and the hours of access to the Festival site will be communicated on the Site.

Anyone participating in the Festival must have left the premises (Festival site itself, campsite, car parks) no later than July 15, 2024 at 2 p.m.

The times of the concerts scheduled during the Festival are given for information purposes only. SA Les Ardentes is entitled, for reasons beyond its control (for example, weather conditions, security reasons, compelling circumstances, cancellation or delay of scheduled artists, events compromising security, etc.) to adapt and/or or to modify the Festival programming without these adaptations and/or changes being considered as a circumstance giving the Customer the right to a total or partial refund, the ticket(s) remaining valid. Indeed, the Client acknowledges and accepts that the Services relate to the Festival in general, considered in its entirety, and not to one or more performance(s) of artist(s) considered individually.

Tickets

Unless otherwise provided, tickets cannot be refunded. Likewise, the theft and loss of tickets do not give rise to a right to a refund or replacement.

The Customer's attention is drawn to the provisions of the law of July 30, 2013 relating to the resale of access tickets to events, which prohibits the resale of tickets on a regular basis, the resale of tickets on an occasional basis at a price higher than the initial purchase price, as well as the sale of privileged or promotional tickets which were not the subject of an initial sale.

Any counterfeit ticket will result in refusal of access to the Festival and may give rise to legal proceedings.

Tickets can be exchanged, only on request and after acceptance by SA Les Ardentes, in particular, to carry out an “upgrade” of the Services concerned. Where applicable, transaction fees depending on the payment method used and service fees may be charged to the Customer during the exchange.

Tickets can also be resold via a resale platform made available via the Site. The Customer will receive the sale price of his/her ticket(s) once the new purchaser(s) have paid the price. Where applicable, transaction fees depending on the payment method used and service fees may be charged to the Customer during the exchange.

Access – Exit

Any person wishing to enter the Festival Site agrees to submit to a security check, carried out in accordance with the legal and regulatory provisions in force, and which may involve searches and pat-downs of people and bags. The Client is free to enter and leave the Festival site as they wish. Each entry is scanned via the bracelet made available to the Customer.

Any person found in possession of prohibited and/or dangerous substances and/or objects may be refused access to the Festival or expelled without being able to claim a refund or exchange their ticket.

The same will apply to any person who, non-exhaustively:

is under the influence of narcotic and/or illicit substances, or in a state of intoxication;
is in possession of narcotic and/or illicit substances, which may be confiscated by security personnel;
adopts behavior and/or clothing and/or distinctive signs likely to incite violence, hatred, racism, xenophobia, etc., and generally to disturb public order and/or peace ;
is in possession of prohibited items, which may be confiscated by security personnel;
refuses to comply with the security controls put in place;
harms the physical integrity of other people present on site or could represent a threat as such;
does not comply with the Conditions and, in particular, the internal regulations.
Any person present on the Festival site agrees to submit, at all times, to the instructions of SA Les Ardentes, its representatives and/or its agents and security personnel so that, throughout the duration of the Festival, the security and public order are optimally maintained.

Any person present on the Festival site accepts that as such, the Festival may be interrupted or canceled, that persons present on the Festival site are prohibited from entering, leaving said site or, on the contrary , that they be given orders to remain there until further notice.

Prohibited items

The following items are, in particular, prohibited:

any narcotic product whatsoever;
liquid, gaseous and pasty substances in containers of more than 100ml and generally any flammable product (medications may be kept on presentation of a prescription or medical certificate not more than 15 days old);
sharp, cutting, blunt, pointed objects, and any weapon or any object that could constitute a weapon of any kind;
drones;
animals, with the exception of guide dogs;
drinks and food not sold on the Festival site;
banners;
any other object which would be considered by security personnel to present a safety hazard or whose contents could not be identified.
Prohibited behaviors

The following behaviors are, in particular, prohibited:

enter areas prohibited to the public;
not leaving access and exit areas to the Festival site and emergency exits free at all times;
climb on barriers, stages, and in general on all structures whatever they are present on the Festival site;
sell food and drinks without official authorization from SA Les Ardentes;
urinating in public;
completely or partially conceal one's face so as to no longer be recognizable;
throw any projectile;
make fire ;
do internship diving;
engage in any criminally reprehensible behavior;
carry out canvassing, promotion or sales without having been expressly authorized by SA Les Ardentes.

 


ARTICLE 12 – PARKING

The Customer can, when placing their ticket order or independently of it, reserve a ticket giving access to a parking space within the car parks dedicated to the Festival.

This access ticket does not allow access to a specific parking space.


ARTICLE 13 – CAMPSITE

The Customer can, when placing their ticket order or independently of it, reserve a ticket giving access to a campsite within the campsite dedicated to the Festival.

This access ticket does not allow access to a specific campsite.

On the campsite, only tents are allowed. All vehicles of any kind are prohibited (including scooters, bicycles and electric bikes, self-balancing scooters, etc.).

The campsite is subject to the following specific internal regulations:

Access conditions

Customers are likely to be subject to checks of the contents of their luggage, as well as pat-downs by security agents, at the entrance to the campsite.

The campsite is only accessible with a 4-day + Camping Pass.

Access to the campsite is reserved for festival-goers over 16 years old.

Any minor under the age of 18 must be accompanied by a responsible adult within the campsite.

Anyone who does not meet these conditions will be refused access to the campsite.

Type of tent allowed

No tents are provided at the “regular” campsite except for Customers who have already reserved their tent when booking their tickets.

The maximum usable surface area for setting up a tent is 4m2 (2 person pitch) to 9m2 (4 person pitch). Tents with built-in seating areas will not be permitted. Additional structures such as awnings, arbors, stretched tarpaulins, swimming pools, etc. are prohibited.

Prohibited items:

The following items are, in particular, prohibited:

Narcotic products;
The perfumes. Gas-free deodorants (roll-on type) as well as sun creams are authorized in formats of maximum 100 ml;
Glass containers (empty plastic or metal bottles of maximum 1 L. are permitted);
Tin cans;
Alcohol (bottle, flask, etc.). Cans of beer are authorized up to a maximum of 6 cans of 50cl per person.
Soft drinks (carbonated or energy drinks) are authorized up to 6 cans or plastic bottles (maximum 50 cl) per person.
Water pipes, shishas, etc.;
Generators;
Tools (open-end wrenches, pliers, shovels) that can be used to dismantle the grills;
All types of fires exceeding the size of a lighter flame (candles, braziers, burners and other gas installations, etc.). A cooking area is provided in the host village. It is possible to come and cook food there. Food cooking will be carried out only by volunteers based on times posted near the cooking points.
Sharp, blunt objects and any other material that could pose a risk to the safety of the campsite (weapons, bladed and prohibited weapons, syringes, fireworks, firecrackers, etc.).
Domestic animals, with the exception of guide dogs.
In general, all articles referred to in article 11 of these Conditions, if not expressly deviated from above.

Any person found in possession of prohibited and/or dangerous substances and/or objects may be refused access to the campsite or expelled without being able to claim a refund or exchange their ticket.

Prohibited behaviors

The following behaviors are, in particular, prohibited:

use sound devices (e.g. sound system, speakers, etc.). Music that is too loud is not allowed, respect for the comfort and in particular the sleep of other users of the campsite and those living near the campsite is essential.
Any commercial activity and in particular the sale of food, drinks, or other;
Distribution of flyers, leaflets, leaflets and other promotional materials.
Climbing, opening or damaging the infrastructure, fraudulently introducing prohibited objects into the campsite;
Any inappropriate, inappropriate, and/or criminally reprehensible behavior;
In general, all prohibited behavior referred to in Article 11 of these Conditions, if not expressly waived above.

Cleanliness

Customers are responsible for the cleanliness of the area they occupy. In the event of failure to fulfill their obligation to keep said area clean at all times, Customers may be expelled from the campsite and the Festival without being able to claim any reimbursement for their tickets and without prejudice to the rights of SA Les Ardentes or third parties of claim damages from them.

 


ARTICLE 14 – INTELLECTUAL PROPERTY RIGHTS

The entire content of the Site, including in particular graphics, logos, buttons, images, HTML code, database and icons - with the exception of advertisements and proper names - is the intellectual property of SA Les Ardentes and is protected.

SA Les Ardentes prohibits the extraction and/or reuse of all or a substantial part in qualitative or quantitative terms of the content of this Site, without its prior, written and express consent.

Some of the names, distinctive signs and logos appearing on the Site are registered trademarks or commercial names belonging to SA Les Ardentes or to third parties. Any copy, translation, adaptation, modification or use whatsoever of the entirety or any of the protected elements of the Site, in any form whatsoever and by any means whatsoever, is strictly prohibited without prior written consent of SA Les Ardentes. Any query on this subject can be addressed to helpdesk@lesardentes.be

Any Internet user and any Customer undertakes to respect these intellectual property rights and not to copy, reproduce, extract, exploit or alter, in any form whatsoever and by any means whatsoever, the information contained on the Site. , including these Conditions. In the absence of prior written consent, SA Les Ardentes does not grant any license in this regard.

Thus, the use of the Les Ardentes brand in the context of contests or commercial actions carried out on social networks, notably with the aim of increasing visibility, is strictly forbidden.

 


ARTICLE 15 - COMMUNICATIONS

Unless otherwise provided for in these Conditions, any communication to be made to the Client will be deemed to have been correctly carried out if it is sent to the electronic or postal address indicated by the Client when concluding the Contract.


ARTICLE 16 – PROTECTION OF PERSONAL DATA

The Client's attention is also expressly drawn to the fact that when the Contract is concluded through an official partner of SA Les Ardentes, the Client's personal data is processed by this official partner and in accordance with its instructions. own privacy policy. As a result, SA Les Ardentes cannot be considered responsible for the processing of this data by this official partner.

The Customer's attention is also expressly drawn to the fact that in the event of purchasing Services on behalf of third parties, it is their responsibility to obtain the consent of these third parties with regard to the processing of their data. personal data by SA Les Ardentes and, where applicable, by its official partners.


ARTICLE 17 – IMAGE RIGHT – PHOTOS AND VIDEOS

The Client acknowledges and agrees to be filmed during the Festival as well as the processing of these images by SA Les Ardentes and its possible partners.

In the absence of prior written authorization from SA Les Ardentes, photos or videos taken by the Client during the Festival, at the Festival venue, cannot be distributed for commercial and/or public purposes without express consent. , prior and written by SA Les Ardentes.

The Festival is also monitored by cameras in accordance with applicable legal provisions. This camera surveillance is carried out for security purposes and the recordings made on this occasion will only be transmitted to the competent authorities in compliance with the applicable legal provisions.


ARTICLE 18 - WAIVER

No waiver by SA Les Ardentes of any of its rights can be inferred except from the express, certain and written expression to this effect.


ARTICLE 19 - VOID

The invalidity of any clause of these Conditions will be limited to the void clause and will not affect the remainder of these Conditions.


ARTICLE 20 - APPLICABLE LAW

Belgian law is applicable, to the exclusion of rules of private international law.


ARTICLE 21 – ONLINE SETTLEMENT OF CONSUMER DISPUTES

In accordance with article 14 of European regulation 524/2013 of May 21, 2013 relating to the online resolution of consumer disputes, SA Les Ardentes communicates here the link to the online dispute resolution platform http://ec .europa.eu/odr via which the Customer can request extrajudicial settlement of a dispute.


ARTICLE 22 – COMPETENT JURISDICTIONS

Any dispute will fall under the jurisdiction of the courts of Liège (Belgium), Liège Division, without prejudice to the application of article 624, 1°, 2° and 4° of the Judicial Code.
